Affiliate Program Terms & Conditions

1.Overview

Welcome to the Remembering You Affiliate Program. By applying to or participating in this program, you agree to these Terms & Conditions. These terms govern your participation in the program and your relationship with Remembering You.

If you do not agree to these terms, please do not participate in the Affiliate Program.

2.Eligibility

The Affiliate Program is open to individuals, businesses and organisations that have been approved by Remembering You.

We reserve the right to approve or decline any application at our sole discretion.

3.Affiliate Commission

Approved affiliates will receive:

• 30% commission on every successful Lifetime Plan purchase made using their unique affiliate referral code or referral link.
• Commissions are calculated on the final amount paid by the customer, excluding any taxes, refunds or chargebacks.

No commissions are payable on free plans or any products that are not specifically designated as commissionable.

4.Commission Eligibility

A commission is earned only when:

• the customer purchases a Lifetime Plan;
• the purchase is completed successfully;
• payment has been received by Remembering You; and
• the affiliate's referral code or referral link is correctly applied during the purchase process.

If no referral code or tracking link is used, no commission can be claimed retrospectively.

5.Commission Payments

Affiliate commissions are paid:

• At the end of each calendar month
• For all eligible commissions earned during that month.

Affiliates are responsible for providing accurate payment details.

Remembering You may withhold payment until minimum identity or payment verification requirements have been completed.

6.Refunds and Chargebacks

If a purchase is refunded, reversed, disputed or charged back, the associated commission will not be payable.

If a commission has already been paid for a refunded purchase, Remembering You reserves the right to deduct that amount from future commission payments.

7.Promotional Guidelines

Affiliates may promote Remembering You through ethical and lawful marketing methods, including:

• websites
• blogs
• newsletters
• email marketing
• printed materials
• social media
• direct referrals

Affiliates must not:

• make false or misleading claims
• impersonate Remembering You
• misrepresent pricing or features
• engage in spam or unsolicited bulk messaging
• use deceptive advertising practices
• bid on Remembering You trademarks in paid advertising without written permission

8.Brand Usage

Affiliates may use approved Remembering You logos, graphics and marketing materials supplied by us.

Logos and branding must not be modified without prior written approval.

9.Independent Relationship

Affiliates act as independent contractors.

Participation in the Affiliate Program does not create any employment, agency, franchise, joint venture or partnership relationship.

10.Taxes

Affiliates are solely responsible for reporting and paying any taxes arising from commissions received.

Remembering You does not provide tax advice.

11.Termination

Either party may terminate participation in the Affiliate Program at any time.

Remembering You may immediately suspend or terminate an affiliate account if an affiliate:

• breaches these Terms & Conditions;
• engages in fraudulent or unethical conduct;
• damages the reputation of Remembering You; or
• violates applicable laws.

Any unpaid commissions that were legitimately earned before termination may still be paid at Remembering You's discretion, provided these Terms have been complied with.

12.Program Changes

Remembering You may modify:

• commission rates;
• payment schedules;
• promotional materials;
• program benefits; or
• these Terms & Conditions,

at any time.

Updated terms will apply from the date they are published on our website.

13.Limitation of Liability

To the maximum extent permitted by law, Remembering You will not be liable for any indirect, incidental, consequential or special damages arising from participation in the Affiliate Program.

14.Privacy

Any personal information collected during your participation in the Affiliate Program will be handled in accordance with the Remembering You Privacy Policy.

15.Governing Law

These Terms & Conditions are governed by the laws of the jurisdiction in which Remembering You operates.

Any disputes shall be resolved under the applicable courts of that jurisdiction.
